Our case is currently pending in the&lt;br \/&gt;\nHudson County court system. In late August we will file motions&lt;br \/&gt;\nthat will argue for the acquittal of our charges upon necessity,&lt;br \/&gt;\nde minimus, and constitutional grounds (see enclosed article from&lt;br \/&gt;\nACLU newsletter).&lt;\/p&gt;\n&lt;p&gt;Currently ACT UP New York operates four &#8220;permanent&#8221; needle&lt;br \/&gt;\nexchange sites: one in Manhattan, two in Brooklyn, and one in the&lt;br \/&gt;\nBronx. We hope to be starting similar programs in New Jersey in&lt;br \/&gt;\nthe near future, law or no law.&lt;\/p&gt;\n&lt;p&gt;In March, 1990, ten activists from ACT UP New York and the&lt;br \/&gt;\nNational AIDS Brigade were arrested on the Lower East Side of&lt;br \/&gt;\nManhattan. These cases are still pending in Manhattan Criminal&lt;br \/&gt;\nCourt and will be heard in September. In early August, a Motion&lt;br \/&gt;\nto Dismiss was filed. Over forty letters of support from service&lt;br \/&gt;\nproviders, doctors, researchers, etc. were attached in an&lt;br \/&gt;\nappendix to the motion, making it a powerful document that helped&lt;br \/&gt;\nta contextualize the issue raised by the arrests.&lt;br \/&gt;\nI am writing to ask you for your help. We believe that the&lt;br \/&gt;\nmotion we file in the New Jersey case must reflect, as did the&lt;br \/&gt;\nNew York motion, the opinions and recommendations of&lt;br \/&gt;\norganizations and individuals who share our commitment to seeing&lt;br \/&gt;\neffective harm reduction strategies for drug users become&lt;br \/&gt;\nstandards of care and health policy priorities in this country .&lt;br \/&gt;\nThe court needs to hear from the real experts&#8211;those of us who&lt;br \/&gt;\ncare for drug addicts and people with AIDS, and members of&lt;br \/&gt;\ncommunities affected by drug use and AIDS&#8211;to counter the&lt;br \/&gt;\narguments that will be made by the law enforcement people.&lt;br \/&gt;\nI am asking you to send us a letter of support which will be&lt;br \/&gt;\nappended to our motion.
