On<br \/>\nApril 19, two members of our Committee, along with one member of<br \/>\nACT UP New Jersey and one member of the Boston-based National<br \/>\nAIDS Brigade, were arrested in Jersey City for attempting to<br \/>\ndistribute free, clean hypodermic needles and bleach kits to<br \/>\nintravenous drug users. Our case is currently pending in the<br \/>\nHudson County court system. In late August we will file motions<br \/>\nthat will argue for the acquittal of our charges upon necessity,<br \/>\nde minimus, and constitutional grounds (see enclosed article from<br \/>\nACLU newsletter).<\/p>\n<p>Currently ACT UP New York operates four “permanent” needle<br \/>\nexchange sites: one in Manhattan, two in Brooklyn, and one in the<br \/>\nBronx. We hope to be starting similar programs in New Jersey in<br \/>\nthe near future, law or no law.<\/p>\n<p>In March, 1990, ten activists from ACT UP New York and the<br \/>\nNational AIDS Brigade were arrested on the Lower East Side of<br \/>\nManhattan. These cases are still pending in Manhattan Criminal<br \/>\nCourt and will be heard in September. In early August, a Motion<br \/>\nto Dismiss was filed. Over forty letters of support from service<br \/>\nproviders, doctors, researchers, etc. were attached in an<br \/>\nappendix to the motion, making it a powerful document that helped<br \/>\nta contextualize the issue raised by the arrests.<br \/>\nI am writing to ask you for your help. We believe that the<br \/>\nmotion we file in the New Jersey case must reflect, as did the<br \/>\nNew York motion, the opinions and recommendations of<br \/>\norganizations and individuals who share our commitment to seeing<br \/>\neffective harm reduction strategies for drug users become<br \/>\nstandards of care and health policy priorities in this country .<br \/>\nThe court needs to hear from the real experts–those of us who<br \/>\ncare for drug addicts and people with AIDS, and members of<br \/>\ncommunities affected by drug use and AIDS–to counter the<br \/>\narguments that will be made by the law enforcement people.<br \/>\nI am asking you to send us a letter of support which will be<br \/>\nappended to our motion. Sawyer Papers: <a href=\"https:\/\/profiles.nlm.nih.gov\/spotlight\/lw\/feature\/yellowfeverlab\">The Yellow Fever Laboratory: Rockefeller Foundation, 1928-1937<\/a>\u2014Wilbur Augustus Sawyer (1879\u20131951) was a key figure in preventive medicine and international public health during the first part of the twentieth century. As a public health administrator, Sawyer helped expand public health departments and integrate laboratory science into public health work, both in the U.S. and abroad. Soper (1893\u20131977) was an American epidemiologist and public health administrator who won a Lasker Award in 1946 for organizing successful campaigns to eradicate yellow fever and malaria between 1927 and 1945. He also made key contributions to the control of typhus fever during World War II, and served as director of the Pan American Sanitary Bureau (the executive agency of the Pan American Health Organization) from 1947 to 1959.
