<p class="Normal"><strong>Background</strong></p>
|
|
|
|
<p class="Normal">Promoting equity is essential to NIH’s mission of seeking fundamental knowledge about the nature and behavior of living systems and the application of that knowledge to enhance health, lengthen life, and reduce illness and disability. This view is reflected in <a href="https://www.whitehouse.gov/briefing-room/presidential-actions/2021/01/20/executive-order-advancing-racial-equity-and-support-for-underserved-communities-through-the-federal-government/">Executive Order (E.O.) 13985</a> entitled Advancing Racial Equity and Support for Underserved Communities Through the Federal Government (Jan. 20, 2021).</p>
|
|
|
|
<p class="Normal">NIH complies with all federal civil rights laws that prohibit discrimination on the basis of race, color, national origin, disability, age, and applicable conscience protections. In addition, it complies with applicable laws that prohibit discrimination on the basis of sex, which includes discrimination on the basis of gender identity, sexual orientation, and pregnancy. Compliance with these laws requires taking reasonable steps to provide meaningful access to persons with limited English proficiency and providing programs that are accessible to and usable by persons with disabilities.</p>
|
|
|
|
<p class="Normal">In order to further non-discrimination, NIH will be making grant and cooperative agreement recipients aware of their responsibilities to administer their awards in compliance with federal civil rights laws that prohibit discrimination.</p>
|
|
|
|
<p class="Normal"><strong>Applicability</strong></p>
|
|
|
|
<p class="Normal">Effective immediately, NIH is updating and implementing HHS language on the Non-Discrimination Legal Requirements for Recipients of Federal Financial Assistance. All Notices of Funding Opportunity (NOFOs) (i.e. Funding Opportunity Announcements) </span></span> and Notices of Award (NoAs) will include the updated non-discrimination language.</p>
|
|
|
|
<p class="Normal"><strong>Policy</strong></p>
|
|
|
|
<p class="Normal">The updated language below applies to all active NIH NOFOs and NOFOs issued on or after the date of this notice.</p>
|
|
|
|
<p class="Normal" style="margin-left: 25px;">Should the applicant organization successfully compete for an award, recipients of federal financial assistance (FFA) from NIH will be required to complete an HHS Assurance of Compliance form (HHS 690) in which the recipient agrees, as a term and condition of receiving the grant, to administer their programs in compliance with federal civil rights laws that prohibit discrimination on the basis of race, color, national origin, age, sex and disability, and agreeing to comply with federal conscience laws, where applicable. This includes ensuring that entities take meaningful steps to provide meaningful access to persons with limited English proficiency; and ensuring effective communication with persons with disabilities. Where applicable, Title XI and Section 1557 prohibit discrimination on the basis of sexual orientation, and gender identity, The HHS Office for Civil Rights provides guidance on complying with civil rights laws enforced by HHS. <p class="Normal">The following language will be added to Section 3 of all new </span></span>NIH NoAs:</p>
|
|
|
|
<p class="Normal" style="margin-left: 25px;">Recipients must administer the project in compliance with federal civil rights laws that prohibit discrimination on the basis of race, color, national origin, disability, age, and comply with applicable conscience protections. The recipient will comply with applicable laws that prohibit discrimination on the basis of sex, which includes discrimination on the basis of gender identity, sexual orientation, and pregnancy. Compliance with these laws require taking reasonable steps to provide meaningful access to persons with limited English proficiency and providing programs that are accessible to and usable by persons with disabilities. The HHS Office for Civil Rights provides guidance on complying with civil rights laws enforced by HHS. <p class="Normal">The following language will be added to the Administrative Terms Section for all new </span></span>NIH NOFOs and Section 3 for NoAs:</p>
|
|
|
|

<li class="Normal">Recipients of FFA must ensure that their programs are accessible to persons with limited English proficiency. For guidance on meeting the legal obligation to take reasonable steps to ensure meaningful access to programs or activities by limited English proficient individuals see <a href="https://www.hhs.gov/civil-rights/for-individuals/special-topics/limited-english-proficiency/fact-sheet-guidance/index.html">https://www.hhs.gov/civil-rights/for-individuals/special-topics/limited-english-proficiency/fact-sheet-guidance/index.html </a>and <a href="https://www.lep.gov/">https://www.lep.gov</a>.</li>
