<p class="heading2">Purpose</p>
|
||
<p>This Notice amends and supersedes the guidance previously issued on June 23, 2017 (NOT-OD-17-083), concerning NIH’s implementation of the requirements for Protecting Life in Global Health Assistance (PLGHA) policy.</p>
|
||
<p><strong>Effective Date</strong></p>
|
||
<p>Effective January 3, 2019, the National Institutes of Health (NIH) has implemented the revised requirements of PLGHA through terms and conditions of award for all global health assistance to new grants and cooperative agreements, and to existing awards when amended to add new funding.</p>
|
||
<p><strong>Background</strong></p>
|
||
<p>When initially implemented, the PLGHA policy requirements extended only to Foreign NGOs supported by the President’s Emergency Plan for AIDS Relief (PEPFAR).</p>
|
||
<p><strong>Applicability</strong></p>
|
||
<p>This revised Guide Notice extends the applicability of the PLGHA policy to foreign NGO subrecipients of U.S. state or local governmental entities, including state universities, (U.S. public institutions). Therefore, all foreign NGOs (e.g. foreign private institutions) directly supported by or subrecipients of U.S. public or private NGOs that receive U.S. global health assistance; specifically, PEPFAR, are subject to implementation and enforcement of PLGHA. U.S. based public and private universities are prohibited from issuing a sub-award to a foreign NGO unless that foreign NGO agrees to abide by the terms of the PLGHA policy.</p>
|
||
<p>For NIH, this policy applies to all awards for global health assistance provided under the President’s Emergency Plan for AIDS Relief (PEPFAR).</p>
|
||
<p>Each organization will have the opportunity to indicate its agreement to abide by the terms of the new policy by accepting the provisions in its award.Foreign NGOs that agree not to perform or actively promote abortion as a method of family planning or provide financial support to any other foreign NGO that conducts such activities, will remain eligible for U.S. global health assistance funding.</p>
|
||
<p>For purposes of the policy, a foreign NGO is a for-profit or not-for-profit nongovernmental</p>
|
||
<p>organization not organized under the laws of the United States, any U.S.</p>
|
||
<p>State or Territory, the District of Columbia, or the Commonwealth of Puerto Rico.</p>
|
||
<p>This policy does not apply to national or sub-national governments, public international</p>
|
||
<p>organizations, and other multilateral entities. For example, the following are exempt from PLGHA implementation: Global Fund to Fight AIDS, Tuberculosis and Malaria; GAVI, the Vaccine Alliance; and United Nations organizations such as the Joint United Nations Programme on HIV/AIDS and the World Health Organization.<br>
